Description
Attorney Matthew Goldberger represented a client charged with DUI and child endangerment after he was stopped by Fish and Wildlife officers in a Florida wildlife management area. The client’s four children were in the bed of his pickup truck enjoying a slow-speed “hay-bale” ride on a dirt road. Although officers recovered numerous empty beer cans in the cab of the truck, they failed to record whether they were cold to the touch. At a jury trial, the officers conceded that they had no idea when the empty beers were consumed or by whom. The jury rightfully concluded that the client was harassed by law enforcement while enjoying the great outdoors with his family, and returned a not guilty verdict.
