Description
A client was stopped in Jupiter, Florida for failing to signal a lane change. The officer noted that he detected signs of impairment and ordered the client out of the vehicle, against his wishes. The client politely declined to perform field sobriety exercises and the officer placed him under arrest. A subsequent search of the client revealed a small quantity of narcotics in his pocket. After obtaining bodyworn camera footage from the police, attorney Matthew Goldberger realized that the officer’s report was inaccurate and full of embellishment. The firm filed a motion to suppress all evidence, arguing that there was no probable cause for the stop nor reasonable suspicion to justify ordering the client out of his car. After reviewing the footage and the defense motion, state prosecutors made the correct decision to nolle prosse, or dismiss, the charges.
